Update: Halozyme Wins Injunction Against Merck's Keytruda SC in Multiple EU Markets

11:15 AM EDT, 10/07/2026 (MT Newswires) -- (Updates with Merck's response in the sixth paragraph.) Halozyme Therapeutics (HALO) has been awarded an injunction by the specialized Dutch patent court in The Hague that stops manufacture and sale of Merck's (MRK) Keytruda SC in multiple European markets, the company said on Wednesday. The court found that Merck infringed one of Halozyme Therapeutics' MDASE patents, Halozyme said. It ordered Merck's market authorization holder, MSD, to stop manufacturing, marketing or importing Keytruda SC in Belgium, Denmark, France, Ireland, Italy, Sweden, Switzerland and the Netherlands. The decision further rejected Merck's arguments that Halozyme Therapeutics' patent was invalid, according to a statement. The injunction does not affect the intravenous version of Keytruda, which remains available to patients, Halozyme said. Merck strongly disagrees with the Dutch court's decision to grant a cross-border injunction and is evaluating its next steps, a company spokesperson told MT Newswires in an emailed response.
